As DOT qualified Substance Abuse Professionals (SAP), we evaluate employees who have violated a DOT drug and alcohol program regulation. Our team makes recommendations relative to education, treatment, follow-up alcohol/drug testing, and aftercare in such violations. Addiction Recovery Services LLC also offers alcohol and drug prevention/intervention services in addition to Drug-Free Workplace services to employer.

Alcohol Drug Counseling Services

The U. S. Department of Transportation’s 49 CFR Part 40 is a DOT-wide regulation that states how to conduct alcohol/drug testing and how to return employees to safety-sensitive duties after they violate a DOT Drug and Alcohol Regulation. Part 40 applies to all DOT-required testing, regardless of what DOT agency-specific rule applies to an employer. For example, whether you are an airline covered by FAA rules or a trucking company covered by FMCSA rules, Part 40 procedures for collecting, testing specimens, and reporting of test results apply to you.

If an employee wishes to return to any DOT safety-sensitive role following a DOT alcohol/drug rule violation in the transportation industry, individuals must follow administrative rulings in each respective industry like:

  • ➩ FMCSA Federal Motor Carrier Safety Administration
  • ➩ FAA Federal Aviation Administration
  • ➩ USCG United States Coast Guard
  • ➩ FRA Federal Railroad Administration
  • ➩ PHMSA Pipeline and Hazardous Materials Safety Administration
  • ➩ FTA Federal Transit Administration

OR if an employee wishes to be hired by a different DOT-covered employer, he/she MUST successfully complete the DOT return-to-duty process.
